Immigration & Foreigners Law in Alanya
Alanya is home to one of the largest foreign resident communities in Turkey. Residence permits, work authorizations, real estate acquisition, and citizenship applications are dynamic legal domains characterized by frequent regulatory amendments and rigorous administrative scrutiny. Our legal practice encompasses proactive management of foreign clients’ legal status in Turkey, administrative appeals against permit denials, and litigation before the Administrative Courts.
In Turkish immigration law, understanding active administrative practice is just as vital as statutory knowledge: documentation protocols, interview appointments, and fee schedules enforced by the Provincial Directorate of Migration Management (İl Göç İdaresi) evolve frequently. Filing under an incorrect permit category or submitting non-compliant documents risks months of delay or outright rejection. Representation by an immigration lawyer provides clarity, predictability, and compliance.
Our Legal Services in Immigration & Citizenship Law
Residence Permit (İkamet) Applications & Extensions
Strategic guidance, document preparation, and file management for short-term, family, student, and long-term residence permits before the Migration Directorate. Choosing the appropriate statutory ground and properly documenting legitimate intent directly impacts application approval. We provide scheduled tracking to prevent missed extension windows.
Work Permit Applications
Complete work permit filings, renewals, and exemption assessments for foreign professionals seeking employment and Turkish companies hiring foreign personnel. We conduct pre-application audits on statutory employer requirements (capitalization, employment ratios, quotas) to eliminate rejection risks.
Turkish Citizenship by Investment
End-to-end legal administration of citizenship by investment filings, predominantly through real estate purchases of at least USD 400,000: eligibility checks, valuation reports, DAB currency exchange certificates, 3-year cadastral restrictions, investor residence permits, and final citizenship dossiers.
Citizenship by Marriage and General Naturalization
Foreign nationals married to a Turkish citizen for at least 3 years, or those with 5 years of continuous legal residence in Turkey, may petition for naturalization. In both routes, statutory criteria including family unity, economic subsistence, and good conduct are scrutinized during interviews and police investigations. We prepare client dossiers meticulously and coach clients thoroughly for administrative interviews.
Administrative Appeals and Lawsuits Against Rejections
Upon receipt of a residence permit, work visa, or citizenship denial, we lodge formal administrative objections and file annulment lawsuits before the Administrative Courts. Statutory objection deadlines are strict; immediate legal action prevents loss of appeal rights and unlawful stay penalties.
Deportation Orders, Removal Centers & Inadmissibility Bans (Tahdit Codes)
Annulment lawsuits against deportation orders can be filed before the Administrative Court within 7 days of formal notification, automatically staying removal in most circumstances. We also provide urgent representation against administrative detention orders at Removal Centers (Geri Gönderme Merkezi – GGM) and execute formal petition proceedings to remove entry ban codes (Ç-114, G-87, V-69, etc.).
Company Formation & Corporate Structuring for Foreign Investors
In coordination with our Commercial Law practice, we advise foreign entrepreneurs on company incorporation, shareholder agreements, operational licensing, and commercial contracts in Turkey.
Recognition & Enforcement of Foreign Court Judgments (Tanıma-Tenfiz)
Overseas judgments concerning divorce, child custody, alimony, or monetary claims must undergo judicial recognition (tanıma) and enforcement (tenfiz) proceedings in Turkish courts to achieve legal validity in Turkey. This is vital for updating civil registry records and resolving property division.
Family Residence Permits and Family Reunification
For family residence permits for the foreign spouse and children of Turkish citizens or residence permit holders, the sponsor must show income of not less than one third of the minimum wage per family member, general health insurance and suitable accommodation (Law No. 6458, Art. 35).
Student and Humanitarian Residence Permits
Foreigners admitted to higher education in Turkey may obtain a student residence permit (Law No. 6458, Art. 38); foreigners who do not meet the conditions for other permits may, in the cases listed in the Law, be granted a humanitarian residence permit with the approval of the Directorate General (Art. 46).
Turquoise Card Applications
Foreigners assessed as eligible on the basis of their education, professional experience, contribution to science and technology or investment may be granted a Turquoise Card, the first three years of which are a transition period (International Labour Force Law No. 6735, Art. 11).
Removal of Entry Bans and Restriction Codes
Entry bans and restriction codes may be challenged through administrative applications and annulment actions; the Directorate General may lift an entry ban or permit entry for a specified period (Law No. 6458, Art. 9).
Visa and Residence Overstays and Administrative Fines
Foreigners who exceed the duration of their visa, visa exemption or residence permit are subject to administrative fines under Article 102 of Law No. 6458; the length of the overstay and the manner of exit are also taken into account in later entry ban and residence permit assessments.
International Protection Applications
Applications for international protection and the administrative and judicial remedies against negative decisions are regulated in Articles 61 et seq. and Article 80 of Law No. 6458; the time limits for these remedies are shorter than the general time limit for administrative actions.
Reacquisition of Citizenship and Other Exceptional Routes
Persons who lost Turkish citizenship by obtaining permission to renounce it may reacquire it under the conditions set out in the Law (Turkish Citizenship Law No. 5901, Art. 43); exceptional acquisition routes other than investment are listed in Article 12 of Law No. 5901.
Proceedings of Foreigners before Turkish Courts and Security for Costs
Foreigners who file a lawsuit, intervene in proceedings or initiate enforcement proceedings before Turkish courts are, as a rule, required to provide security; the court may grant an exemption on the basis of reciprocity (MÖHUK Art. 48).
Acquisition of Immovable Property by Foreigners through Inheritance
Turkish law applies to succession in respect of immovable property located in Turkey (MÖHUK Art. 20); the transfer of such property to foreign heirs is assessed within the limits set by Article 35 of the Land Registry Law.
